WARRANTY
1.UFO Performance Products does unconditionally warrant that its parts be free from defects in Materials and Workmanship prior to installation. However, UFO Performance Products does not make any warranties expressed or implied including without limitation, warrant to fitness, or Merchantability of any of our products for particular use or purpose due to extreme stress applications to which this product is subjected. All products are for racetrack use only. Any other use may violate the law. Not all parts are certified for highway use. Check your local and state laws. UFO Performance Products disclaims any an all liability for consequential or incidental damages.
2.Use of product(s) at purchaser’s own risk. You agree and acknowledge that the use, installation, and/or operation of this product shall be at your own risk and may result in severe injury, death, and/or damage to person or property.
3.Limitation of Liability. to the fullest extent permitted by applicable law, you agree and acknowledge that UFO Performance Products, shall not be liable for any injury or damage to persons or property, or for any loss of time, inconvenience, or loss of use, including any consequential, incidental, or special damages arising directly or indirectly out of or in connection with this product’s use, installation, and/or performance, whether suffered by the purchaser or any other party, and regardless of the legal theory upon which the claim is based, even if UFO Performance Products has been advised of the possibility of such damages. without otherwise limiting the foregoing, in no event shall recovery of any kind against UFO Performance Products be greater in amount than the purchase price of this product.
4.Miscellaneous. This Disclaimer of Warranties (“Disclaimer”) represents the complete and exclusive agreement between You and UFO Performance Products, and supersedes any prior agreements and/or communications regarding the subject matter hereof. The terms of this Disclaimer shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to any conflict of law principle that would result in the laws of any other jurisdiction governing this Disclaimer. Any action or proceeding arising out of this Disclaimer shall be litigated in courts located in Cuyahoga County, Ohio. You consent and submit to the jurisdiction of any local, state, or federal court located in Cuyahoga County, Ohio . Any cause of action or claim you may have with respect to this product, whether in contract, tort, otherwise, must be commenced within one (1) year after the claim or cause of action arises, or such claim or cause of action is barred. If any term or provision contained in this Disclaimer is determined to be unenforceable in any respect, the enforceability of the term or provision in any other respect, and of the remaining terms or provisions of this Disclaimer, shall not be impaired.
ORDERS
BACKORDERED ITEMS
If an order is placed and it is not in stock, you will be notified and your credit card will be charged for the full amount. We will give you our best estimation on an arrival date based on the information given to us by the manufacturer or distrubuter. You may choose to cancel the backordered item(s) within 48 hours of the order being placed. If you do not contact us, you may be liable for a 20% cancellation fee.
RETURNS
All merchandise returned to UFO Performance Products must have prior approval. Please contact us at (440)582-2525 for return instructions. Returns must be made prepaid. All returns must be accompanied by a copy of the original invoice or email from UFO Performance Products, as well as a complete explanation of reason for return. A 20% restocking charge may be applied to all returned merchandise. NO returns will be accepted after 30 days from invoice date. All returned merchandise must be suitable for resale and NOT USED.
DAMAGED MERCHANDISE
UFO Performance Products ships all merchandise carefully packaged and in good condition. All Shipments are insured. All claims for damaged merchandise must be made with the carrier. All packaging materials must be presented to the carrier with a claim. Do not return damaged merchandise to UFO Performance Products without prior approval.
